United States District Court dismisses Carolina Water Service lawsuit against Town of Lexington

The Honorable Margaret B. Seymour, United States District Court, has dismissed the lawsuit filed by Carolina Water Service (CWS) based on the motions from the Town of Lexington and Environmental Protective Agency (EPA) without any further oral argument.

On August 1, 2016, South Carolina DHEC denied CWS’ application for National Pollutant Discharge Elimination System (NPDES) permit due to its past history of violation at its I-20 plant.

Their most recent notice of violation was on July 8, 2016 for excessive fecal coliform discharge.

Hopefully the dismissal of this lawsuit will expedite the process of the Town taking over the CWS facility as requested by SCDHEC.
