Richard Davis v. A&E Television Networks is the 2011 “South Carolina Case of the Year.

NEW YORK, NY – March 26, 2012 – The legal publication Benchmark Litigation has named Richard Davis v. A&E Television Networks as the 2011 “South Carolina Case of the Year.”

Billy Wilkins, head of Nexsen Pruet’s Appellate Advocacy Group, and Kirsten Small represented Davis on appeal before the United States Court of Appeals for the Fourth Circuit.
 
The case dates back to 2004, when Davis shopped around his idea of a house-flipping TV show.  He and A&E struck a deal to share net profits equally.  Then, the cable network produced and aired 13 episodes of “Flip this House.”  The programs detailed how Davis’ company, Trademark Properties, renovated and sold houses around South Carolina.
 
At trial in 2006, Davis told the court that he upheld every aspect of the deal, but A&E did not pay.   The heart of the case was an oral agreement.  The jury found in favor of Davis and awarded him $4 million — roughly equal to half of the net revenue for the first season of the show.
 
In April of 2011 the 4th Circuit affirmed that $4 million dollar verdict for Davis.
