July 24, 2025

David E. Rothstein, a South Carolina Supreme Court certified specialist in employment and labor law, has joined Burnette Shutt & McDaniel as its newest partner.

Rothstein has devoted his career to fighting for the underdog, from hourly workers to executives to medical professionals. His three decades of experience in state and federal courts in South Carolina and North Carolina positions him to offer clients solutions in a full range of employment-law disputes, whether the resolution is through negotiation or litigation.

Rothstein has practiced at firms large and small in Columbia and Greenville, most recently at Rothstein Law Firm, P.A. Prior to that, he and Burnette Shutt & McDaniel co-founder practiced together at Burnette & Rothstein, P.A.

“Having previously worked closely with David, I was able to see first-hand the determination, commitment, and impressive legal skill he brings to every case,” Burnette said. “We’re thrilled that he’s joined Burnette Shutt & McDaniel.”

His practice at Burnette Shutt & McDaniel’s new Greenville office incorporates the full range of employment law issues, including discrimination, harassment, overtime and pay disputes, wrongful termination, civil rights violations, and more. He also represents employees facing illegal retaliation after filing complaints.

Rothstein represents employees in the public and private sector. He’s fought for workers in class-action litigation against employers for unpaid overtime and unpaid sleep or break time. His class cases have included first responders.

He also represents executives and medical professionals in contract disputes, including non-compete and non-solicitation agreements.

In addition to employment law, his practice includes qui tam whistleblower actions aimed at exposing government corruption and fraud. He will work from the new Burnette Shutt & McDaniel Greenville office.

A native of Irmo, Rothstein graduated from the University of South Carolina School of Law.
