Road-ready: South Carolina’s new street-legal UTV law takes effect Nov. 18
October 19, 2026Utility Task Vehicles (UTVs) across the Palmetto State will soon have a legal pathway to share public roadways. The South Carolina Department of Public Safety (SCDPS) has issued a 30-day advisory alerting owners that the state’s new UTV legislation officially goes into effect on Wednesday, November 18, 2026.
Under the statute (SC Code 56-2-5000), qualifying UTVs will become eligible for street-legal operation, bringing them under standard traffic laws and introducing strict equipment, driver, and operational standards.
With the countdown underway, here is an essential breakdown of what Golden Strip owners need to know before turning the key on secondary roads.
Who Can Drive and Ride?
The new law establishes clear age, licensing, and safety thresholds for both operators and passengers:
-
Operator Qualifications: Drivers must be at least 17 years old and hold a valid Class D driver’s license.
-
Passenger Age Limit: All passengers must be at least 8 years old.
-
Protective Gear: Anyone under the age of 21 must wear a helmet and goggles or a protective face shield while riding.
-
Restraints: Every occupant in the vehicle must be buckled up.
Required Equipment and Paperwork
To qualify for street-legal status, UTVs must be outfitted with key safety features and registered before driving on public pavement:
-
Vehicle Equipment: The UTV must feature working headlights, tail lights, brake lights, turn signals, and seat belts installed at every seating position.
-
Plates & Registration: Vehicles must carry an official registration certificate and display a valid license plate mounted on the rear.
-
Insurance: Operators must carry active proof of liability insurance coverage.
Where Can You Legally Drive?
Meeting vehicle requirements does not mean UTVs can travel anywhere. The state has outlined specific roadway restrictions:
-
Secondary Roads Only: Street-legal UTVs may only be operated on secondary roads with posted speed limits of 55 mph or less.
-
Distance Limit: Vehicles must remain within 10 miles of the home address listed on the registration certificate.
-
No Interstates: UTVs are strictly prohibited from driving on interstates.
-
Local Rules: Drivers are advised to consult municipal and county ordinances across Mauldin, Simpsonville, and Fountain Inn for any localized rules or additional travel restrictions.
