SCRLA calls for thoughtful approach to hemp-derived THC products in South Carolina
May 4, 2026The South Carolina Restaurant & Lodging Association (SCRLA) is urging members of the South Carolina General Assembly, particularly those serving on the conference committee for H. 3924, to take a measured, deliberate approach to legislation impacting hemp-derived THC consumable products.
As discussion around hemp-infused beverages and consumables has gained momentum at the State House, SCRLA members across South Carolina have expressed growing concern about the potential business implications of sweeping regulatory changes or an outright ban.
“These products are already part of the marketplace and, for many operators, have become an important and growing revenue stream,” said Mark Newman, President & CEO of SCRLA. “An abrupt shift in policy could create significant operational and financial challenges for hospitality businesses across the state.”
The hemp-derived consumables market in South Carolina is currently estimated at $1.2 to $1.5 billion, reflecting both consumer demand and broader shifts in purchasing behavior. As some consumers move away from traditional alcohol products, hemp-infused beverages are emerging as an alternative offering for restaurants, bars, and hospitality venues.
At the same time, SCRLA acknowledges the importance of appropriate oversight and public safety considerations. The Association supports establishing clear, enforceable guidelines – including restricting the purchase and consumption of hemp-derived THC products to individuals aged 21 and over.
Given ongoing federal discussions that could significantly reshape the regulatory landscape for hemp-derived products, SCRLA believes it is premature for South Carolina to enact sweeping changes at the state level.
“To ensure the best possible outcome for businesses, consumers, and regulators alike, we believe it is critical to allow time for greater clarity at the federal level,” Newman added. “In the meantime, stability is essential.”
SCRLA is specifically calling on members of the conference committee to:
- Maintain the current legal status of hemp-derived THC consumable products in the near term
- Adopt a clear 21+ age restriction for purchase and consumption
- Engage in a more deliberate and inclusive stakeholder process to revisit this issue during the next legislative session
SCRLA remains committed to working collaboratively with lawmakers, regulators, and industry stakeholders to develop a responsible, balanced framework that supports both economic opportunity and public safety.
